IF ARRESTED
If you have been charged in a criminal matter, keep in mind that the
less you say about it to anyone, the better off your defense will be.
You have Miranda rights and you should not be intimidated by police
officers, or anyone else, into giving them up. Whether you are an adult
citizen or non-citizen, you have certain rights if you are arrested.
Before a law enforcement officer questions you, he or she should give
you your Miranda Warnings.:
- You have the right to remain silent.
- Anything you say can and will be used against you.
- You have the right to have an attorney present while you are
questioned.
- If you cannot afford an attorney, one will be appointed for you.
Just say that you want to speak with your attorney before you answer
any other questions. Then, call an attorney and see him as soon as possible.
Once you are booked into custody you have a right to make and complete
three phone calls that are free within the local calling area.
The fact is, having an experienced criminal defense attorney on your
side from early stages can often make a big difference in the ultimate
outcome of your case.
